Attempt By Sen. Abe’s Ibrahim Imah, Others To Vacate The Perpetual Injunction Granted Ojukaye-Led Rivers APC EXCO Fails



Moves by some loyalists of Sen. Magnus Abe to vacate the perpetual injunction that was granted in favour of the Ojukaye Flag-Amachree-led Rivers State Executive Committee (SEC) of APC on September 4, 2018 by an Abuja High Court have crashed.

In a ruling delivered by the Presiding Judge, His Lordship, Justice H.B. Yusuf of an Abuja High Court holding at Maitama on 20th September, 2018, the Court declined to rule on a Suit No: FCT/HC/CV/2705/18 filed by the 23 Claimants. The Judge ruled that: “Based on all that I have said, it is my honest view that it is unwise and unprofitable to make further progress in this case, but rather to stay further proceedings pending the decision of the Court of Appeal. This case is accordingly adjourned sine die.”

While H.A. Bello Esq appeared for the Claimants, Oluwole Adaja Esq. put up appearance for the 1st Defendants (Ojukaye-led EXCO) and O.H. Arono Esq for the 2nd set of Defendants (APC and the National Chairman).

It would be recalled that Abuja High Court 14 presided over by His Lordship, Hon. Justice A. O. Musa on Tuesday, September 4, 2018 granted an Order of Perpetual Injunction restraining the All Progressives Congress (APC) and the National Chairman, His Excellency (Comrade) Adams Oshiomhole (1st and 2nd Defendants) from ‘tampering with the mandates of the elected Officials/Delegates elected at the 1st Defendant’s Ward, Local Government and State Congresses in Rivers State on May 19, 20 and 21, 2018 respectively, either by nullifying, removing or in any way refusing to give effect to the outcome of the said congresses or by purporting to conduct another congress in respect of Rivers State.”

With the ruling by Hon. Justice H.B. Yusuf to adjourn the matter sine die, all pending appeals arising from the initial ruling by Court 14 presided by Hon. Justice A.O.
